Decree Law No. 22 of March 25, 2019 (the so-called “Brexit Decree”), which entered into force on March 26, 2016, contains in Article 16, paragraph 3, the following provision, inserted in order to make the effective date of AIRE registration more expeditious and more certain:
“In Article 6 of Law No. 470 of October 27, 1988, after paragraph 9, the following is added: “9-bis. The effects of the declaration made to the consular office, in accordance with paragraphs 1 and 3, shall take effect from the date of submission of the same, if the declaration of transfer of residence abroad to the municipality of last residence has not already been made, in accordance with the registry legislation in force.” Article 7 of Presidential Decree No. 323 of September 6, 1989, is repealed. Declarations referred to in this paragraph submitted prior to the effective date of this decree and not yet received by the registry officer shall take effect on the same date.”
As a result of this, all AIRE registrations made by municipalities based on applications submitted to consular offices on or after March 26, 2019, therefore take effect from the date of submission of the application, provided it is complete.
It is emphasized that, in this way, the effective date of registration in the registry of Italians abroad from the time of application aligns the regime applicable to compatriots abroad with that already provided for registrations in the registry of the population resident in Italy.
