We inform all Italian citizens, parents or guardians of minor children that pursuant to D.L. 69/2023 starting from June 14th, 2023 the other parent’s consent is no longer necessary of for the purpose of issuing their passport.
Specifically, Article 3-bis of Law 1185/1967 states that, when there is a concrete and present danger that a parent may escape the fulfillment of his/her obligations towards the children due to transferring abroad, it will be possible for the other parent to request an injunction to the issuance of the passport.
The request can be submitted to the competent judge at the ordinary Italian Court where the minor has their residence or, if the minor resides abroad, at the Italian Court in which the municipality of AIRE registration of the minor is located.
The obligation of providing the signed consent by both parents -or by those who exercise parental responsibility- In the case of of issuing passports for minors remains.
