The recent Judgment No. 24045\/2026 of the Italian Court of Cassation has revised the interpretative guidelines on the application of Article 7 of Law No. 555 of 13 June 1912, No. 555, which had previously been adopted by Order No. 17161\/2023 of the First Civil Section of the Court of Cassation and subsequently incorporated into the Circular of the Ministry of the Interior dated 3 October 2024, ref. No. 43347.<\/p>\n
The said judgement stipulates that a person born to an Italian parent in a country where citizenship is conferred iure soli, whilst Law No. 555 of 13 June 1912 was in force, retain Italian citizenship pursuant to Article 7 of the aforementioned Law even if the Italian parent lost his citizenship as a result of voluntary naturalisation as a foreign national whilst the child was a minor – \u00a0unless the person concerned subsequently renounced \u00a0Italian citizenship upon reaching the age of majority – thereby ensuring that the line of transmission was not interrupted.<\/p>\n
Consequently, individuals whose applications for recognition of Italian citizenship by descent (iure sanguinis) have been refused on grounds based on the Circular of the Ministry of the Interior dated 3 October 2024, ref. no. 43347, and therefore on the alleged interruption of the line of descent following the loss of citizenship by the parent as a result of naturalisation whilst the child was a minor, may request a review of their application by sending the following documentation to the Consulate General by mail (150 North Michigan Avenue, Suite 1500) or, if through an Italian legal representative, by certified email PEC (con.chicago@cert.esteri.it):<\/p>\n
