These provisions apply to all applications for the registration of birth certificates received by the Consulate General <strong data-start=\"326\" data-end=\"356\">on or after March 28, 2025<\/strong>, the date on which the new legislation entered into force.<\/p>\n<p data-start=\"417\" data-end=\"612\">Since every application for the registration of a birth certificate necessarily requires verification of the child&#8217;s entitlement to Italian citizenship, the new legislation distinguishes between:<\/p>\n<ul data-start=\"614\" data-end=\"794\">\n<li data-section-id=\"zv1744\" data-start=\"614\" data-end=\"697\">children who qualify for <strong data-start=\"641\" data-end=\"692\">Italian citizenship from birth (jure sanguinis)<\/strong>; and<\/li>\n<li data-section-id=\"1y9h9cy\" data-start=\"698\" data-end=\"794\">children who may instead <strong data-start=\"725\" data-end=\"793\">acquire Italian citizenship by operation of law (benefit of law)<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"796\" data-end=\"878\">The applicable requirements and procedures for both situations are outlined below.<\/p>\n<hr data-start=\"880\" data-end=\"883\" \/>\n<p data-section-id=\"qx44qg\" data-start=\"885\" data-end=\"990\"><strong>Registration of a Birth Certificate with Recognition of Italian Citizenship from Birth (Jure Sanguinis)<\/strong><\/p>\n<p data-section-id=\"1xga9kf\" data-start=\"992\" data-end=\"1022\"><strong>Conditions for Registration<\/strong><\/p>\n<p data-start=\"1024\" data-end=\"1184\">A child born abroad to an Italian citizen <strong data-start=\"1066\" data-end=\"1123\">is not automatically recognized as an Italian citizen<\/strong>, unless <strong data-start=\"1132\" data-end=\"1148\">at least one<\/strong> of the following conditions is met.<\/p>\n<h5><span style=\"text-decoration: underline;\"><strong>CASE A<\/strong><\/span><\/h5>\n<blockquote><p><em><strong>The parent who is an Italian citizen from birth, and who also possesses another citizenship, resided in Italy for at least two consecutive years at any time before the child&#8217;s date of birth;<\/strong><\/em><\/p><\/blockquote>\n<p>or<\/p>\n<blockquote><p><em><strong>The parent acquired Italian citizenship after birth (for example, through naturalization or another means) and resided in Italy for at least two consecutive years after acquiring Italian citizenship and before the child&#8217;s date of birth.<\/strong><\/em><\/p><\/blockquote>\n<p><strong><span style=\"color: #ff0000;\">PLEASE NOTE<\/span><\/strong>: Residence in Italy <strong data-start=\"1695\" data-end=\"1737\">prior to acquiring Italian citizenship<\/strong> is <strong data-start=\"1741\" data-end=\"1748\">not<\/strong> taken into consideration. The certificate must show the <strong data-start=\"274\" data-end=\"298\" data-is-only-node=\"\">exact place of birth<\/strong>, the <strong data-start=\"304\" data-end=\"325\">date of birth\/age<\/strong>, and the <strong data-start=\"335\" data-end=\"370\">places of birth of both parents<\/strong>, in accordance with the format issued by the individual U.S. State. The document must be <strong data-start=\"682\" data-end=\"696\">apostilled<\/strong> and accompanied by a <strong data-start=\"718\" data-end=\"750\" data-is-only-node=\"\">complete Italian translation<\/strong>.<\/li>\n<li data-section-id=\"q0d0yg\" data-start=\"753\" data-end=\"1187\"><strong data-start=\"755\" data-end=\"810\">For births that occurred outside the United States:<\/strong> the original <strong data-start=\"824\" data-end=\"842\">certified copy<\/strong> of the child&#8217;s birth certificate, duly legalized, together with a <strong data-start=\"909\" data-end=\"941\">complete Italian translation<\/strong>, faithful to the original, also duly legalized. <strong data-start=\"1993\" data-end=\"2067\">Historical Certificate of Residence (Certificato Storico di Residenza)<\/strong> of the Italian grandparent, issued by the competent Italian Municipality.<\/li>\n<li data-section-id=\"f91rbu\" data-start=\"2143\" data-end=\"2601\"><strong data-start=\"2145\" data-end=\"2205\">If the Italian grandparent resided in a foreign country:<\/strong> a certificate issued by the competent authorities of that country, duly <strong data-start=\"2278\" data-end=\"2292\">apostilled<\/strong> (or legalized by the Italian Consulate\/Embassy if the country is not a party to the 1961 Hague Apostille Convention), together with an <strong data-start=\"2428\" data-end=\"2460\">official Italian translation<\/strong>, certifying that the Italian grandparent <strong data-start=\"2502\" data-end=\"2600\">did not acquire the citizenship of that foreign country before the birth of the child&#8217;s parent<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"2603\" data-end=\"2779\">The Consulate General reserves the right to request any additional documentation necessary to verify that the Italian grandparent did not acquire any other foreign citizenship.<\/p>\n<p data-start=\"2781\" data-end=\"2853\" data-is-last-node=\"\" data-is-only-node=\"\">For additional information, please read the Consequently, acquisition of citizenship by benefit of law <strong data-start=\"1379\" data-end=\"1397\">does not apply<\/strong> where the Italian parent acquired citizenship through any other legal basis, including:\n<ul data-start=\"1488\" data-end=\"1813\">\n<li data-section-id=\"elnjd8\" data-start=\"1488\" data-end=\"1505\">naturalization;<\/li>\n<li data-section-id=\"1lpl5u2\" data-start=\"1508\" data-end=\"1608\">acquisition of Italian citizenship by benefit of law pursuant to <strong data-start=\"1575\" data-end=\"1607\">Article 9 of Law No. 91\/1992<\/strong>;<\/li>\n<li data-section-id=\"xorzk4\" data-start=\"1611\" data-end=\"1710\">acquisition of Italian citizenship through marriage pursuant to <strong data-start=\"1677\" data-end=\"1709\">Article 5 of Law No. 91\/1992<\/strong>;<\/li>\n<li data-section-id=\"1kembx4\" data-start=\"1713\" data-end=\"1813\">acquisition of citizenship <strong data-start=\"1742\" data-end=\"1766\">juris communicatione<\/strong> pursuant to <strong data-start=\"1779\" data-end=\"1812\">Article 14 of Law No. 91\/1992<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li data-section-id=\"1cj05gu\" data-start=\"1815\" data-end=\"2239\"><strong data-start=\"1817\" data-end=\"1833\">Both parents<\/strong> (including the foreign parent), or the child&#8217;s legal guardian, <strong data-start=\"1897\" data-end=\"1967\">must submit a Declaration of Intent to Acquire Italian Citizenship<\/strong> within the mandatory deadline of <strong data-start=\"2001\" data-end=\"2016\">three years<\/strong> from:\n<ul data-start=\"2025\" data-end=\"2239\">\n<li data-section-id=\"7syvjg\" data-start=\"2025\" data-end=\"2053\">the child&#8217;s date of birth;<\/li>\n<li data-section-id=\"apc9f0\" data-start=\"2056\" data-end=\"2135\">the date on which legal parentage with the Italian citizen is established; or<\/li>\n<li data-section-id=\"j5n7wm\" data-start=\"2138\" data-end=\"2239\">the date on which the adoption by an Italian citizen is finalized while the child is still a minor.<\/li>\n<\/ul>\n<\/li>\n<li data-section-id=\"8pxhk3\" data-start=\"2241\" data-end=\"2444\">If legal parentage is established at a later date by <strong data-start=\"2296\" data-end=\"2312\">both parents<\/strong>, who are <strong data-start=\"2322\" data-end=\"2356\">both Italian citizens by birth<\/strong>, the three-year period begins on the date of the <strong data-start=\"2406\" data-end=\"2443\">first acknowledgment of parentage<\/strong>.<\/li>\n<li data-section-id=\"armuay\" data-start=\"2446\" data-end=\"2738\">If, instead, the child is first acknowledged by the <strong data-start=\"2500\" data-end=\"2518\">foreign parent<\/strong> (or by a parent who acquired Italian citizenship through a legal basis other than birth), the three-year period begins on the date of acknowledgment by the <strong data-start=\"2675\" data-end=\"2692\">second parent<\/strong>, who must be <strong data-start=\"2706\" data-end=\"2737\">an Italian citizen by birth<\/strong>.<\/li>\n<li data-section-id=\"uuaozu\" data-start=\"2740\" data-end=\"3066\" data-is-last-node=\"\">Pursuant to the transitional provisions introduced by <strong data-start=\"2796\" data-end=\"2831\">Law No. 26 of February 28, 2026<\/strong>, the three-year deadline (rather than the previous one-year deadline) <strong data-start=\"2902\" data-end=\"2940\">may be extended until May 31, 2029<\/strong>. For information regarding legalization requirements, please refer to the website of the <strong data-start=\"3867\" data-end=\"3899\">Italian Embassy or Consulate<\/strong> having jurisdiction over the country where the birth certificate was issued.<\/li>\n<li data-section-id=\"1senuc8\" data-start=\"3978\" data-end=\"4141\">An <strong data-start=\"3983\" data-end=\"4066\">Extract of the Marriage Record (Estratto per Riassunto dell&#8217;Atto di Matrimonio)<\/strong> issued by the Italian Municipality where the marriage has been registered.<\/li>\n<li data-section-id=\"185kxr4\" data-start=\"4143\" data-end=\"4864\"><strong data-start=\"4145\" data-end=\"4233\">If the parents are not married, or were not married at the time of the child&#8217;s birth<\/strong>, the following additional documentation must be submitted:\n<ul data-start=\"4295\" data-end=\"4864\">\n<li data-section-id=\"1l2w8th\" data-start=\"4295\" data-end=\"4528\">An <strong data-start=\"4300\" data-end=\"4331\">Acknowledgment of Paternity<\/strong> (also known in some U.S. jurisdictions as a <strong data-start=\"4376\" data-end=\"4404\">Certificate of Parentage<\/strong>), duly <strong data-start=\"4412\" data-end=\"4426\">apostilled<\/strong> and accompanied by a <strong data-start=\"4448\" data-end=\"4480\">complete Italian translation<\/strong> that faithfully reflects the original document.<\/li>\n<li data-section-id=\"1rp16vc\" data-start=\"4531\" data-end=\"4864\">In the United States, this document is typically completed and signed by unmarried parents at the hospital shortly after the child&#8217;s birth and is subsequently filed together with the birth record by the local vital records office. It can therefore usually be obtained from the same office that issues the child&#8217;s birth certificate.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p class=\"PDq2pG_selectionAnchorContainer\" data-start=\"4871\" data-end=\"5065\">The <strong data-start=\"4875\" data-end=\"4894\">2026 Budget Law<\/strong> amended <strong data-start=\"4903\" data-end=\"4939\">Article 9-bis of Law No. 91\/1992<\/strong>, providing that <strong data-start=\"4956\" data-end=\"5064\">Declarations of Intent submitted on or after January 1, 2026 are exempt from the \u20ac250 administrative fee<\/strong>.<\/p>\n<p data-start=\"5067\" data-end=\"5269\">Accordingly, <strong data-start=\"5080\" data-end=\"5163\">only applications received by the Consulate General on or after January 1, 2026<\/strong> are no longer subject to the payment of the <strong data-start=\"5208\" data-end=\"5229\">\u20ac250 contribution<\/strong> (as is also the case under <strong data-start=\"5257\" data-end=\"5267\">Case F<\/strong>).<\/p>\n<p data-start=\"5271\" data-end=\"5343\" data-is-last-node=\"\" data-is-only-node=\"\">For additional information, please read the <strong data-start=\"5315\" data-end=\"5328\">IMPORTANT<\/strong> section below.<\/p>\n<p>&nbsp;<\/p>\n<hr \/>\n<h5><strong><span style=\"text-decoration: underline;\">CASE F<\/span><\/strong><\/h5>\n<blockquote>\n<p class=\"PDq2pG_selectionAnchorContainer\" data-section-id=\"1ja1n59\" data-start=\"0\" data-end=\"85\"><em><span role=\"text\"><strong data-start=\"3\" data-end=\"85\">Transitional Provision for Minors Who Were Under the Age of 18 on May 24, 2025<\/strong><\/span><\/em><\/p>\n<\/blockquote>\n<p data-start=\"87\" data-end=\"268\">Following the enactment of <strong data-start=\"114\" data-end=\"149\">Law No. 26 of February 28, 2026<\/strong>, the deadline established by <strong data-start=\"179\" data-end=\"249\">Article 1, paragraph 1-ter, of Decree-Law No. 36 of March 28, 2025<\/strong> has been extended.<\/p>\n<p data-start=\"270\" data-end=\"579\">This provision amended the transitional rule that allows an exception to the general <strong data-start=\"355\" data-end=\"378\">three-year deadline<\/strong> from the child&#8217;s birth, from the date legal parentage with an Italian citizen is established, or from the date on which an adoption by an Italian citizen is finalized while the child is still a minor.<\/p>\n<p data-start=\"581\" data-end=\"1012\">Under the transitional provision, <strong data-start=\"615\" data-end=\"734\">children who were minors on May 24, 2025, and who have at least one parent who is an Italian citizen jure sanguinis<\/strong>, may submit the <strong data-start=\"751\" data-end=\"825\">Declaration of Intent to Acquire Italian Citizenship by Benefit of Law<\/strong> <strong data-start=\"826\" data-end=\"848\">until May 31, 2029<\/strong> (instead of the previous deadline of <strong data-start=\"886\" data-end=\"902\">May 31, 2026<\/strong>), subject to the **same eligibility requirements and following the same procedure described under <strong data-start=\"1001\" data-end=\"1011\">Case E<\/strong>.<\/p>\n<p data-start=\"1014\" data-end=\"1166\" data-is-last-node=\"\" data-is-only-node=\"\">Please note that, <strong data-start=\"1032\" data-end=\"1165\">for applications received by the Consulate General on or after January 1, 2026, the \u20ac250 administrative fee is no longer required<\/strong>.<\/p>\n<p>&nbsp;<\/p>\n<div style=\"border: 1px solid #d1d5db; background: #f8f9fa; padding: 20px; border-radius: 8px;\">\n<p><span style=\"color: #ff0000;\"><strong><u>IMPORTANT!!! (cases E and F)<\/u><\/strong><\/span><\/p>\n<p class=\"PDq2pG_selectionAnchorContainer\" data-start=\"18\" data-end=\"278\">Applicants are strongly encouraged to submit a <strong data-start=\"65\" data-end=\"121\">Declaration of Intent to Acquire Italian Citizenship<\/strong> <strong data-start=\"122\" data-end=\"241\">only after obtaining all of the documentation necessary to establish the child&#8217;s entitlement to Italian citizenship<\/strong>, as listed in the previous sections.<\/p>\n<p data-start=\"280\" data-end=\"594\">If the request is submitted <strong data-start=\"308\" data-end=\"346\">without the required documentation<\/strong>, the Consulate General will send a <strong data-start=\"382\" data-end=\"414\">preliminary notice of denial<\/strong> pursuant to <strong data-start=\"427\" data-end=\"465\">Article 10-bis of Law No. 241\/1990<\/strong> to the email address indicated in the application. The applicant will then have <strong data-start=\"546\" data-end=\"557\">10 days<\/strong> to submit the missing documentation.<\/p>\n<p data-start=\"596\" data-end=\"996\">The Consulate General also reserves the right to request <strong data-start=\"653\" data-end=\"681\">additional documentation<\/strong> other than that listed above whenever it is deemed necessary to verify the child&#8217;s entitlement to Italian citizenship.
