{"id":6205,"date":"2026-03-26T14:13:45","date_gmt":"2026-03-26T19:13:45","guid":{"rendered":"https:\/\/conschicago.esteri.it\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/divorzio\/"},"modified":"2026-07-13T11:36:47","modified_gmt":"2026-07-13T16:36:47","slug":"divorzio","status":"publish","type":"page","link":"https:\/\/conschicago.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/divorzio\/","title":{"rendered":"Divorce"},"content":{"rendered":"<p class=\"PDq2pG_selectionAnchorContainer\" data-start=\"11\" data-end=\"186\">A divorce granted abroad becomes legally effective in Italy <strong data-start=\"71\" data-end=\"108\">only after it has been registered<\/strong> in the civil status records of the competent Italian Municipality (<em data-start=\"176\" data-end=\"184\">Comune<\/em>).<\/p>\n<p data-start=\"188\" data-end=\"301\">In order to be registered, the foreign divorce judgment must satisfy the requirements established by Italian law.<\/p>\n<p data-start=\"303\" data-end=\"601\">Divorce judgments issued by U.S. courts generally meet these requirements and are, in most cases, eligible for registration in Italy. However, the final decision regarding the registration always rests with the Civil Registrar (<em data-start=\"531\" data-end=\"561\">Ufficiale dello Stato Civile<\/em>) of the competent Italian Municipality.<\/p>\n<p data-start=\"603\" data-end=\"891\">If the marriage was celebrated in Italy, the divorce judgment must be registered with the same Municipality where the marriage was celebrated. If the marriage was celebrated abroad, the divorce must instead be registered with the Municipality where the marriage was previously registered.<\/p>\n<p data-start=\"893\" data-end=\"1250\"><strong data-start=\"893\" data-end=\"909\">Please note:<\/strong> a divorce <strong data-start=\"920\" data-end=\"930\">cannot<\/strong> be registered in Italy unless the corresponding marriage has already been registered in Italy. If the marriage has never been registered, you must first submit the documentation required for the registration of the marriage, following the instructions available in the <a href=\"https:\/\/conschicago.esteri.it\/en\/servizi-consolari-e-visti\/servizi-per-il-cittadino-italiano\/stato-civile\/matrimonio\/\" target=\"_blank\" rel=\"noopener\"><strong data-start=\"1200\" data-end=\"1225\">Marriage Registration<\/strong><\/a> section of this website.<\/p>\n<div class=\"entry-content\">\n<p class=\"PDq2pG_selectionAnchorContainer\" data-section-id=\"183y3g3\" data-start=\"1257\" data-end=\"1277\"><strong>REQUIRED DOCUMENTS<\/strong><\/p>\n<ul data-start=\"1279\" data-end=\"2546\">\n<li data-section-id=\"z8gl3x\" data-start=\"1279\" data-end=\"1361\"><strong data-start=\"1281\" data-end=\"1324\">Application for Registration of Divorce<\/strong> (<a href=\"https:\/\/conschicago.esteri.it\/wp-content\/uploads\/2026\/07\/Modulo-Trascrizione-Divorzio-Chicago.pdf\" target=\"_blank\" rel=\"noopener\">Divorce Registration Request Form<\/a>);<\/li>\n<li data-section-id=\"gbqoza\" data-start=\"1362\" data-end=\"1445\"><strong data-start=\"1364\" data-end=\"1414\">Substitute Declaration in Lieu of an Affidavit<\/strong> (<a href=\"https:\/\/conschicago.esteri.it\/wp-content\/uploads\/2026\/07\/Dichiarazione-Sostitutiva-Atto-Notorieta-Chicago.pdf\" target=\"_blank\" rel=\"noopener\">Substitute Declaration Form<\/a>);<\/li>\n<li data-section-id=\"1hwjug4\" data-start=\"1446\" data-end=\"1693\"><strong data-start=\"1448\" data-end=\"1515\">Certified copy of the Final Judgment of Dissolution of Marriage<\/strong> (also known as the <strong data-start=\"1535\" data-end=\"1558\">Judgment of Divorce<\/strong>), issued by the competent Court and bearing an <strong data-start=\"1606\" data-end=\"1619\">Apostille<\/strong> issued by the Secretary of State of the State where the Court is located;<\/li>\n<li data-section-id=\"1hwjug4\" data-start=\"1446\" data-end=\"1693\"><strong data-start=\"1696\" data-end=\"1749\">Certificate confirming that the judgment is final<\/strong> (commonly referred to as a <strong data-start=\"1777\" data-end=\"1805\">Certificate of No Appeal<\/strong>), issued in original by the competent Court and bearing an <strong data-start=\"1865\" data-end=\"1878\">Apostille<\/strong>. This document is issued in a wide variety of formats depending on the State and County where the divorce was granted. It may be titled, for example, <strong data-start=\"2032\" data-end=\"2055\">Letter of No Appeal<\/strong>, <strong data-start=\"2057\" data-end=\"2087\">Certificate of Disposition<\/strong>, <strong data-start=\"2089\" data-end=\"2112\">Clerk&#8217;s Certificate<\/strong>, or similar. Regardless of its title, the document must clearly state that <strong data-start=\"2188\" data-end=\"2247\">no appeal has been filed and that the judgment is final<\/strong>. <em data-start=\"2249\" data-end=\"2269\">(<a href=\"https:\/\/conschicago.esteri.it\/wp-content\/uploads\/2026\/07\/Documento-No-appeal-Chicago.pdf\" target=\"_blank\" rel=\"noopener\">See sample here.<\/a>)<\/em><\/li>\n<li data-section-id=\"gbkj0n\" data-start=\"2271\" data-end=\"2379\"><strong data-start=\"2273\" data-end=\"2305\">Complete Italian translation<\/strong> of both the <strong data-start=\"2318\" data-end=\"2341\">Judgment of Divorce<\/strong> and the <strong data-start=\"2350\" data-end=\"2378\">Certificate of No Appeal<\/strong>;<\/li>\n<li data-section-id=\"rzpeva\" data-start=\"2380\" data-end=\"2546\"><strong data-start=\"2382\" data-end=\"2415\">Photocopy of a valid passport<\/strong>, preferably the Italian passport, of the person signing the application (photo page, personal data page, and signature page only).<\/li>\n<\/ul>\n<p class=\"PDq2pG_selectionAnchorContainer\" data-section-id=\"iqn5nc\" data-start=\"2553\" data-end=\"2566\"><strong>PLEASE NOTE<\/strong><\/p>\n<ul data-start=\"2568\" data-end=\"3132\">\n<li data-section-id=\"waalyr\" data-start=\"2568\" data-end=\"2787\"><strong data-start=\"2570\" data-end=\"2652\">Every single word, number, stamp, annotation, heading, signature, and notation<\/strong> appearing on the original document must be translated.
