The new ruling modifies law n.91 (February 5, 1992). You may read the complete text regarding the Italian citizenship law at following <a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:1992-02-05;91!vig=\"><strong>link<\/strong><\/a><\/strong><\/p>\n<p><strong>IMPORTANT<\/strong><\/p>\n<p>1) The citizenship applications submitted before March 27, 2025, will be processed following previous law, provided they are complete with all required documentation.<\/p>\n<p>2) The citizenship applications submitted during an appointment scheduled on Prenot@mi platform before March 27, 2025, will be processed following previous law. Applications must be complete with all required documentation.<\/p>\n<p>3) In all other circumstances, citizenship applications will follow the current, new law.<\/p>\n<p>* * *<\/p>\n<p>The current legislation on citizenship, Law No. 91 of 1992, as well as the previous Law No. 555 of 1912, are based on the principle of ius sanguinis, i.e. the transmission of citizenship by descent from an Italian citizen. In particular, Article 1 of Law 91\/1992 establishes that:<\/p>\n<p>\u2018<em>The child of an Italian father or mother is an Italian citizen by birth<\/em>.\u2019<\/p>\n<p><strong><u>However<\/u><\/strong>, Law 91\/1992 was recently amended by Decree-Law No. 36\/2025, converted with amendments by Law No. 74\/2025, which introduced some restrictions on the automatic transmission of Italian citizenship.<\/p>\n<p><u>a.1) Restrictions on the automatic transmission of citizenship for those born abroad<\/u><\/p>\n<p>The new Article 3-bis, paragraph 1, of Law 91\/1992 establishes that \u2018a person born abroad, even before the date of entry into force of this article AND holds another citizenship, is considered never to have acquired Italian citizenship\u2019.<\/p>\n<p><u>a.2) Exceptions to these restrictions<\/u><\/p>\n<p>Notwithstanding the above, Article 3-bis provides for exceptions that allow for the recognition of citizenship at birth, even for those born abroad and holding another citizenship, in the following cases:<\/p>\n<ol>\n<li>Italian citizenship is recognized on the basis of an application submitted to the Consulate General by 11:59 p.m. (Rome time) on 27 March 2025, or on the basis of an appointment confirmed to the applicant (automatic email of confirmation which follows the registration on the prenot@mi portal) by the same date;<\/li>\n<li>The applicant\u2019s parent or grandparent holds, or held at the time of death, only the Italian citizenship.<\/li>\n<li>A parent (including adoptive parents), who is an Italian citizen, has been resident in Italy for at least two consecutive years after acquiring Italian citizenship and before the birth or adoption of the child.<\/li>\n<\/ol>\n<p><strong>N.B.1 The exceptions do not affect the principle of the iure sanguinis transmission of citizenship, which will continue to apply, and with it the necessary checks that the transmission was not interrupted.<\/strong><\/p>\n<p><strong>N.B.2 The application of exception no. 1 means that both the applications submitted before 27 March 2025 and the applications, accompanied by the necessary documentation, for which confirmation of the appointment by the Consular Office (automatic email of confirmation which follows the registration on the prenot@mi portal) was issued by 23:59 Rome time, on 27 March 2025, are decided upon according to the previous rules.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p><strong>Who\u00a0can apply<\/strong><\/p>\n<p><span style=\"text-align: justify;\">In order to submit your application to this Consulate, you must be a permanent resident of one of the following States:\u00a0<strong>Colorado, Illinois, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota, South Dakota, Wisconsin, Wyoming<\/strong>. (Legal Aliens must submit the Permanent Resident Card). Residents outside the above jurisdiction must apply to the\u00a0<\/span><a style=\"text-align: justify;\" href=\"https:\/\/conschicago.esteri.it\/wp-content\/uploads\/2023\/06\/Consular-jurisdiction.pdf\"><strong>Consular Authority <\/strong><\/a>under whose jurisdiction they reside.<\/p>\n<p><strong>Schedule\u00a0an appointment and fees<\/strong><\/p>\n<p><span style=\"text-align: justify;\">Please be informed that this Consulate General receives citizenship jure sanguinis applications by appointment only. All applicants over the age of 18 must schedule an appointment online. The<\/span>\u00a0<a href=\"https:\/\/prenotami.esteri.it\/\"><strong>BOOKING ONLINE SYSTEM <\/strong><\/a>allows applicants to select the date and time of\u00a0the appointment based on availability.<\/p>\n<p>As of July 8th, 2014, all applications for the recognition of Italian citizenship Jure Sanguinis (by descent) and Jure Matrimonii (for women who married an Italian citizen prior to April 27, 1983) are subject to the payment of the consular fee \u201cDOMANDA DI RICONOSCIMENTO CITTADINANZA Art. 07B\u201d. Payment needs to be made by money order or cashier\u2019s check. <strong>Please note that consular fees are updated every quarter and published on our website, the applicable fee is the one in effect during the quarter of the appointment.<\/strong> Once the application is received, the office will send an email confirming receipt. The fee will be collected regardless of the outcome of the evaluation of the application, save for inadmissible applications.<\/p>\n<p><strong>How to apply<\/strong><\/p>\n<p>Starting July 1st, 2026, applications for citizenship recognition must be submitted exclusively by mail. In order to avoid any discrepancy between the payment and the current fees (which are updated every quarter), it is required that applications arrive at the Consulate <strong>between the 1<sup>st<\/sup> and the 20<sup>th<\/sup> of your appointment month<\/strong> (for example, if your appointment is scheduled on July 24<sup>th<\/sup>, 2026, your application should arrive between July 1<sup>st<\/sup> and July 20<sup>th<\/sup> 2026). You may use any postal service of your choice, but please make sure the application is delivered within the required timeframe. All documentation must be sent to the Consulate General of Italy in Chicago and submitted as originals or certified copies; photocopies will not be accepted. A pre-stamped envelope must be enclosed with the application, to be used for returning the documentation should the application be deemed ineligible. Please note that, except in cases where the application is deemed inadmissible, the documents submitted will not be returned to the applicant, who may only request a certified copy by paying the relevant consular fee.<\/p>\n<p><strong>Inadmissibility of the application<\/strong><\/p>\n<p>The application will be immediately declared inadmissible and will not be evaluated unless the following essential requirements are met: 1) the existence of valid appointment and the receipt of the application between the 1st and 20th day of the month of the appointment; 2) payment of the consular fee; 3) submission of the petition (Form 1) bearing a signature notarized by a Notary Public; 4) a photocopy of the applicant\u2019s U.S. passport (if not a U.S. citizen: a photocopy of the applicant\u2019s national passport and permanent resident card); 5) proof of residence within the consular jurisdiction (driver\u2019s license and utility bill).
